§ 1 Provider & Scope

These ToS apply to all users of the “Clubius” app. The providers of the app are Burak Hafizoglu and Furkan Bacak (hereinafter “Provider”), located at Pardemannstraße 5, 14109 Berlin.

The app is intended exclusively for users who are at least 18 years old. By installing and registering, you confirm that you are at least 18 years old and you bindingly accept these ToS.

§ 2 Services & Warranty

Clubius provides event, venue, nightlife and social app features, including Find/Match, likes, chats, groups and offer/deal information. Clubius is not the organizer/operator of third-party events or venues.

DISCLAIMER: To the extent permitted by law, we provide no warranty regarding completeness, legality, accuracy, timeliness, entry rights, or successful redemption of offers/deals.

§ 2a License for Use & Acceptable Use

You are granted a limited, non-exclusive, revocable license to use the app for personal use only. You agree not to misuse the app, including but not limited to: spamming, reverse engineering, violating laws, unauthorized access to systems or data, or any other activity that compromises the security or functionality of the app.

§ 2b Prohibited Conduct

The following behaviors are expressly prohibited:

• Spamming or sending unsolicited messages
• Harassment, stalking, threats, hate speech, sexual harassment
• Non-consensual intimate content (including revenge porn)
• Illegal drug promotion/facilitation, or unlawful activity
• Data harvesting/scraping of other users
• Impersonation or fake identities
• Any activity that violates applicable laws

Violations may result in content removal, restrictions, suspension, or termination.

§ 2d Find, Matching and Chat Rules

Clubius is an 18+ social nightlife app. Users must behave respectfully in profiles, likes, matches, direct messages, friend requests and groups.

§ 2d1 Profile Photos, Nudity and Image Content

Pornographic or clearly explicit profile images are not allowed. Illegal, violent, abusive, discriminatory or drug-promoting image content is prohibited.

§ 2e Bar Offers, Discounts and Deals

Offers may be limited by time, quota, venue rules and partner conditions. Display of an offer does not create a guaranteed right to entry, service, discount, or payout.

§ 2c Content Correction & Removal

Organizers, club owners, bar owners, or DJs can contact us to correct or remove information, and we will act within 24 hours of receiving your request. Requests must concern publicly available professional information. Please contact us at support@clubius.app with your request and appropriate proof of your identity or authorization.

§ 3 Registration & Security

Use requires registration. You assure that all information provided is truthful. You are obliged to keep your access data secret and protect it from access by third parties. You must inform us immediately of any suspected misuse.

§ 4 User Data & Privacy

Depending on the used features, this includes account/profile data, social interaction data (likes, matches, chats, groups), safety reports, and technical logs, all processed according to our Privacy Policy.

We do not store passwords in plain text and use secure encryption methods. For detailed information on data processing, please refer to our Privacy Policy.

§ 4a Club Ratings

You can rate clubs you have visited with 1–5 stars. Ratings are voluntary and serve to help other users in their selection.

• Ratings must be honest and factual.
• You may not publish offensive, discriminatory, or illegal content.
• The Provider reserves the right to remove abusive ratings.
• Your ratings are linked to your account but can be viewed by other users in aggregated form (average).
• You can modify or delete your own ratings at any time.

§ 5 Availability & Costs

The basic functions of the app are free. There is no claim to constant availability of the servers. Maintenance work may lead to temporary downtimes.

§ 5a Third-Party Services & APIs

The app uses third-party services/APIs (e.g., Supabase, Expo, Spotify, SoundCloud). Third-party terms and privacy policies apply.

§ 5b Third-Party Metadata Sources

Public metadata sources (e.g., Spotify/SoundCloud APIs) may be used for classification and profile links. Clubius is not affiliated with or endorsed by these providers.

§ 5c Third-Party Links

External links are voluntary and used at your own risk under third-party policies.

§ 5d Matching Algorithm

Algorithmic suggestions are non-binding and do not guarantee outcomes.

§ 5e Location Use for Map & Matching

Location features require permission and can be revoked in device settings at any time.

§ 5f Moderation, Restriction & Removal

We may remove content or restrict/terminate accounts to protect users and enforce rules/law.

§ 6 Limitation of Liability

The Provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

For slight negligence, we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. No liability for algorithmic recommendations.

§ 6a Intellectual Property & Data Sources

Event data is informational. No ownership is claimed over third-party names, trademarks, or logos. All trademarks, logos, and names belong to their respective owners. The use of such information is solely for informational purposes.

§ 7 Changes to Terms

We reserve the right to change these ToS at any time to adapt them to changed legal situations or technical developments. Significant changes will be communicated to you in the App. You agree that continued use of the App after notification of changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must discontinue use of the App.

§ 8 Online Dispute Resolution (EU)

The European Commission provides an Online Dispute Resolution platform.

§ 9 Final Provisions & Severability

If any clause is invalid, remaining clauses remain valid. German law applies, subject to mandatory consumer protections.
