Terms of Service

Welcome to Clubius. Please read these Terms of Service (“ToS”) carefully. These terms govern the use of the Clubius App and define your rights and obligations.

§ 1 Provider & Scope

These ToS apply to all users of the “Clubius” app. The providers of the app are Burak Hafizoglu and Furkan Bacak (hereinafter “Provider”), located at Pardemannstraße 5, 14109 Berlin.

The app is intended exclusively for users who are at least 18 years old. By installing and registering, you confirm that you are at least 18 years old and you bindingly accept these ToS.

§ 2 Services & Warranty

Clubius provides information about events and clubs. However, the Provider is not the organizer of the displayed events. Event classifications are algorithmic estimations.

DISCLAIMER: We assume no liability for the accuracy, completeness, or timeliness of the data (e.g., ticket prices, opening hours). We do not guarantee completeness or legality of event data — please verify independently. Likewise, we guarantee NO entry into the clubs. The decision lies solely with the club operator ("Bouncer"). Compensation claims due to refused entry are excluded.

§ 2a License for Use & Acceptable Use

You are granted a limited, non-exclusive, revocable license to use the app for personal use only. You agree not to misuse the app, including but not limited to: spamming, reverse engineering, violating laws, unauthorized access to systems or data, or any other activity that compromises the security or functionality of the app.

§ 2b Prohibited Conduct

The following behaviors are expressly prohibited:

  • Spamming or sending unsolicited messages
  • Data harvesting or collecting data from other users
  • Impersonation or pretending to be another person
  • Any activity that violates applicable laws

Violations of these provisions may result in immediate termination of your account.

§ 2c Content Correction & Removal

Organizers, club owners, bar owners, or DJs can contact us to correct or remove information, and we will act within 24 hours of receiving your request. Requests must concern publicly available professional information. Please contact us at support@clubius.app with your request and appropriate proof of your identity or authorization.

§ 3 Registration & Security

Use requires registration. You assure that all information provided is truthful. You are obliged to keep your access data secret and protect it from access by third parties. You must inform us immediately of any suspected misuse.

§ 4 User Data & Privacy

During registration, users primarily provide the following personal data: email address, password, music preferences, and age. Your email address, password, music preferences, and age are all protected and treated confidentially in accordance with our Privacy Policy.

We do not store passwords in plain text and use secure encryption methods. For detailed information on data processing, please refer to our Privacy Policy.

§ 4a Club Ratings

You can rate clubs you have visited with 1–5 stars. Ratings are voluntary and serve to help other users in their selection.

  • Ratings must be honest and factual.
  • You may not publish offensive, discriminatory, or illegal content.
  • The Provider reserves the right to remove abusive ratings.
  • Your ratings are linked to your account but can be viewed by other users in aggregated form (average).
  • You can modify or delete your own ratings at any time.

§ 5 Availability & Costs

The basic functions of the app are free. There is no claim to constant availability of the servers. Maintenance work may lead to temporary downtimes.

§ 5a Third-Party Services & APIs

The app uses third-party services and APIs (e.g., Supabase, Expo). Your use of such services is subject to their respective terms of service and privacy policies. We assume no liability for the availability, functionality, or content of such third-party services.

§ 5b Third-Party Metadata Sources

We use third-party APIs (e.g., Spotify Web API) solely to analyze publicly available artist information. All retrieved data is processed outside the app and converted into internal music style classifications. No raw Spotify data or identifiers are stored. Clubius is not affiliated with or endorsed by Spotify.

§ 6 Limitation of Liability

The Provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

For slight negligence, we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. No liability for algorithmic recommendations.

§ 6a Intellectual Property & Data Sources

Event data is informational. No ownership is claimed over third-party names, trademarks, or logos. All trademarks, logos, and names belong to their respective owners. The use of such information is solely for informational purposes.

§ 7 Changes to Terms

We reserve the right to change these ToS at any time to adapt them to changed legal situations or technical developments. Significant changes will be communicated to you in the App. You agree that continued use of the App after notification of changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must discontinue use of the App.

§ 8 Online Dispute Resolution (EU)

The European Commission provides a platform for Online Dispute Resolution (ODR). We are not obliged and not willing to participate in dispute settlement proceedings before a consumer arbitration board.

§ 9 Final Provisions & Severability

Should individual provisions of this contract be invalid, the rest of the contract remains valid. German law applies, excluding the UN Sales Convention. The place of jurisdiction is Berlin.
